November 2006 - April 2007 OVI Cases

4/18/07 – Licking County Municipal Court. Plea to OVI, dismissal of No Operator’s License charge. Client received jail sentence for third offense with early release through Step Program.

4/9/07 – Franklin County Municipal Court. Sentencing on high test OVI with mandatory 3 days in jail and yellow “drunk” plates. Negotiated plea to low test with three day program, minimum fine and no probation.

4/4/07 – Westerville Mayor’s Court. OVI refusal case. Obtained a stay of client’s administrative license suspension permitting client to begin driving again without restrictions while OVI case is pending.

3/15/07 – Upper Arlington Mayor’s Court. Negotiated high test OVI with mandatory 3 days in jail and yellow “drunk” plates to low test with three day program, no jail and 2 years probation. Minimum fine and costs.

3/6/07 – Dublin Mayor’s Court. Obtained a stay of client’s administrative license suspension permitting client to begin driving again without restrictions while OVI case is pending.

3/6/07 – Franklin County Municipal Court. High test OVI with mandatory 3 days in jail and yellow “drunk” plates. Police officer did not have probable cause to stop client. Negotiated a plea to Reckless Driving (M3) with a three day program, fine and costs, and driver’s license suspension back dated to 9/27/07. Non reporting probation.

2/28/07 – Franklin County Municipal Court. OVI charge with a refusal to take BAC test. Negotiated a plea to down from OVI/drunk driving to reckless operation of a motor vehicle.

2/20/07 – Franklin County Municipal Court. Negotiated high test OVI with mandatory 3 days in jail and yellow “drunk” plates to low test OVI.

2/2/07 -- Clark County Municipal Court. Sentencing on OVI. Minimum fine and court costs, three day program with 6 month suspension backdated to date of offense. No probation.

12/4/06 – Franklin County Municipal Court. Negotiated high test with mandatory 3 days in jail and yellow “drunk” plates to non moving violation/Physical Control of a Motor Vehicle While Under the Influence of a Motor Vehicle. Termination of the administrative license suspension; prosecutor stipulated error. No suspension of client’s driver’s license. Non reporting probation.

11/3/06– Delaware County Municipal Court. Jury trial for refusal case. After prosecutor’s presented his case and I cross examined the arresting officer, prosecutor offered to reduce OVI charge to reckless driving. Court granted motion for error on administrative license suspension and returned client to full driving privileges.

11/9/06 – Franklin County Municipal Court. Refusal case. Obtained stay of client’s administrative license suspension permitting client to drive without restrictions during case.
